CAR RENTAL TERMS AND CONDITIONS IN TUNISIA
Before Renting Your Car in Tunisia: Prerequisites
To rent a car in Tunisia with REGENCY RENT A CAR, a set of conditions must be met. You are required to provide supporting documents and fulfill certain requirements to finalize your reservation. In the interest of full transparency, we invite you to review the terms and conditions governing the conclusion of a car rental agreement in Tunisia with REGENCY RENT A CAR.
1 - Definitions and General Provisions
The terms used in these conditions shall be interpreted in accordance with the recommendations of the Commission on Unfair Terms and the general law applicable to lease agreements governed, under Tunisian law, by Articles 726 and 727 of the Code of Obligations and Contracts.
The rental agreement is concluded intuitu personae and may not be assigned.
- “You” / “the renter”: refers to the drivers and payers named in and signing the rental agreement.
- “We” / “the lessor”: refers to REGENCY RENT A CAR, as indicated in the rental agreement.
- “Vehicle”: refers to a passenger car or utility vehicle rented for the agreed duration.
- “Damage”: any damage to the vehicle, including glass breakage (lights, mirrors, headlights).
- “Theft”: includes vandalism, theft of accessories, and attempted theft.
- “Tunisia”: the country where the vehicle is authorized to circulate. Use outside Tunisia is strictly prohibited unless expressly authorized by REGENCY RENT A CAR.
2 - Conditions:
To rent a vehicle, you must provide the following:
- Identity document (passport)
- Address (home and email)
- Telephone details
- Driving license (number, issue/expiry date, place of issue)
- Payment method
Failure to provide this information will result in refusal of the reservation.
A second form of identification (utility bill less than 3 months old) and a valid credit card (matching the one used for booking) will be required before vehicle delivery to cover additional charges.
⚠️ Important:
Failure to provide documents, obtain bank authorization, or provide accurate information will result in refusal of rental and forfeiture of prepaid amounts.
American Express cards are not accepted.
Driver requirements:
- Minimum age: 25 years (may vary by category)
- Minimum driving license validity: 36 months
- Drivers aged 22–25: additional fee of 5 TND/day
⚠️ The same credit card used for booking must be presented.
Cancellation Policy
- Free cancellation up to 2 days before pickup
- Fees apply thereafter
- July & August bookings are non-refundable
Modification Policy
- Free modification up to 3 days before pickup (except July & August)
- Fees may apply in July & August
COVID-19 note: Refunds may not be guaranteed; requests are handled case by case.
3 - The Vehicle
3.1 Vehicle Condition
A condition report is attached. You must report any visible defect before departure.
Unreported damage will be deemed your responsibility.
You must return the vehicle in the same condition. Repair costs due to fault will be charged.
3.2 Use of the Vehicle
- Use is restricted to Tunisia
- You are liable for all traffic violations
- Authorities may access your information
You must:
- Use the vehicle responsibly
- Not drive under alcohol or drugs
- Use the vehicle according to its purpose
⚠️ Utility vehicles require special caution due to size limitations.
⚠️ Damage due to misjudging vehicle size is not covered.
Prohibited uses include:
- Subleasing
- Paid passenger transport
- Exceeding passenger limits
- Racing or testing
- Driving instruction
- Towing (except authorized cases)
- Off-road driving
- Intentional offenses
You must lock the vehicle when parked.
4 - Rental Duration
4.1 Calculation
- Vehicle must be returned on time
- Grace period: 120 minutes
- Up to 2 extra hours charged
- Beyond that: full day charged
⚠️ Maximum rental: 3 months (renewable only, no extension allowed)
⚠️ No refund for early return
4.2 Extension
Must be requested 48 hours in advance with payment.
The company may refuse.
4.3 End of Rental
Return must be made to a REGENCY RENT A CAR agent.
- Cleaning fee: 40 TND if needed
- Fuel: same level (¼ tank)
- Missing keys: 150 TND
Inspection is recommended in your presence.
⚠️ Responsibility ends only after official handover.
5 - Pricing and Payment
- Prices are non-discountable and non-transferable
- Include insurance with deductible (non-waivable)
- Same credit card required
⚠️ Maestro, Electron, Aurore cards not accepted
- 24-hour billing basis
- Extra mileage: 0.200 TND/km
- Fraud = legal action
Deposit
Depends on vehicle and coverage
Refunded if no damage or extra charges
6 - Liability
You are responsible for:
- Damage
- Theft
- Repair costs
- Loss of use
You will be charged the deductible, plus any additional costs if applicable.
7 - Insurance
7.1 Coverage
- Third-party insurance
- Accident report required within 48h
- Responsible driver pays damages
- Theft/fire covered if keys/documents returned
Obligations
You must:
- Report incidents within 48h
- Provide full details
- Attach official reports
Failure results in full liability.
7.2 Loss of Coverage
Coverage is void if:
- Unauthorized driver
- Violation of contract terms
8 - Fines and Violations
You are responsible for all:
- Fines
- Tickets
- Impound costs
MODIFICATION AND CANCELLATION TERMS
Article 1 – Modification Policy
- Access via customer account
- Possible before confirmation
- Must be requested 48h before pickup
- Free if no price change
- Otherwise recalculated
Date changes require cancellation and new booking.
Article 2 – Cancellation Policy
A reservation is confirmed via official email from:

Confirmation includes:
- Vehicle model
- Rental period
- Price
- Flight details
- Payment details
Unconfirmed reservations can be canceled by simple reply.
Confirmed reservations:
- Cancel via account OR
- Email at least 48h before pickup
Professional email communication is required for all requests to ensure traceability.

GENERAL CAR RENTAL TERMS AND CONDITIONS
The company “Regency Car Rental” leases vehicles in accordance with the information stated on the first page and the following clauses, which the renter (“lessee”), after reading and reviewing them, expressly accepted, approved, and signed as follows:
1 – Use of the Vehicle:
The renter undertakes to personally drive the vehicle under their sole responsibility and legal custody, and not to hand it over to any third party. Failing this, the renter shall bear all resulting consequences.
The renter also agrees to use the vehicle exclusively for personal purposes and:
not to participate in any type of competition,
not to use the vehicle for unlawful purposes,
not to transport prohibited goods or merchandise,
not to transport unauthorized or undesirable persons, even free of charge,
not to exceed the number of passengers indicated on the vehicle registration document.
Leaving Tunisian territory is strictly prohibited.
The renter undertakes to return the vehicle at the place, date, and time specified in the contract. Any delay resulting in traffic violations (fines or reports) shall be borne by the renter, including any related administrative or travel costs.
2 – Condition of the Vehicle:
The renter acknowledges having received the rented vehicle from “Regency Car Rental” in good condition, with all its accessories, equipment, documents, and without any notable defects.
The renter agrees to return the vehicle, at the end of the rental period, within the agreed time and place and in the same condition as received.
The renter shall bear the cost of:
all damages to tires,
all glass components and lights,
any damage to equipment or documents,
and the rental cost corresponding to the time required for repairs.
The cost of reissuing documents in case of loss or damage is set at 300 Tunisian dinars.
3 – Fuel and Oils:
The renter undertakes to use only the appropriate fuel and oils for the rented vehicle.
They must regularly check:
the engine cooling water level,
engine oil,
and all other vehicle fluids,
and replace them whenever necessary.
The renter will be reimbursed for oil replacement expenses upon presentation of proof during the rental period and after notifying the company.
4 – Maintenance, Repairs, and Towing:
Normal mechanical wear is the responsibility of the lessor.
In case of mechanical failure or damage resulting from negligence or improper use by the renter, the renter shall be liable for:
full repair costs,
towing costs to the company’s premises,
and the cost of immobilization of the vehicle.
During the repair period, the renter shall pay 50% of the full daily rental rate for each day the vehicle is unavailable.
It is strictly forbidden to repair the vehicle outside the lessor’s premises without prior written authorization.
If towing is required due to breakdown, accident, or inability to return the vehicle, the cost shall be borne by the renter, except in cases of normal mechanical wear.
5 – Rental Fee and Security Deposit:
At the time of rental, the renter must:
pay the full rental amount for the agreed period,
provide a security deposit.
The deposit shall be refunded at the end of the rental period unless there is a valid reason for withholding it.
Extension of the rental period is not allowed without prior written approval from “Regency Car Rental” and payment for the additional period.
6 – Liability:
The renter bears full responsibility for the use and maintenance of the vehicle during the entire rental period until its return.
The lessor is released from any liability arising from violations or offenses committed by the renter, who shall be solely responsible for paying fines.
The renter is considered the legal custodian of the vehicle in accordance with Article 96 of the Tunisian Code of Obligations and Contracts.
In case of dispute not settled amicably, jurisdiction lies with the courts where “Regency Car Rental” is headquartered.
7 – Insurance and Accidents:
Insurance coverage is void if:
the renter fails to comply with any condition of Article 1,
or drives under the influence of alcohol or any prohibited condition under the law.
In case of accident or incident, the renter must:
immediately notify the competent authorities and the lessor,
use any written means of communication,
complete all legal procedures (reports, statements, etc.) within 24 hours,
provide all relevant information and the location of the vehicle,
and act with due diligence.
Failure to notify or providing false/incomplete information resulting in loss of compensation rights shall make the renter solely responsible for:
all repair costs,
and loss of use of the vehicle during the repair period.
8 – Termination of Contract:
“Regency Car Rental” reserves the right to:
terminate the contract,
repossess the vehicle,
if the renter violates any clause or is deemed unfit to drive.
The renter:
cannot claim a refund for the remaining rental period,
cannot terminate the contract after signing and taking possession of the vehicle.
